A short summary of Assisted Living

What is it called?

NY State has traditionally had licensed adult homes and enriched housing, offering care and personal assistance services in a residential setting.  Several years ago facilities opened in NY calling themselves assisted living but not obtain licensure as an adult home or enriched housing.

In 2004, the state passed an assisted living licensure law  which requires that all residential facilities providing assisted living services apply for and obtain licensure as an adult home or enriched housing under NY law.  If a licensed facility wishes to call itself assisted living it must apply for and receive certification to do so.

In addition, the 2004 law requires that facilities that advertise or market themselves as caring for people with special needs, such as dementia, apply for and receive Special Needs Assisted Living Residence certification.  Similarly, if a facility wants to admit or retain residents who exceed the retention standards for adult homes & assisted living, they must apply for and receive an Enhanced Assisted Living Residence Certificate.

·        Personal care and/or health care services

 
Is any public payment available?

·        Currently, limited Medicaid reimbursement is available for home care services under the Assisted Living Program (ALP).
